A real estate/property is a particle of the earth's surface along with everything with the land permanently connected to the surface or below it. This means that buying an apartment at the same time buy and an ideal part of the building on which the building is constructed, or if you buy the land lot, you become the owner of all that is built on it.
Our agency, REAL ESTATE CENTER ZADAR, will try as soon as possible to find a buyer for your property. We'll do all the necessary actions in order to present it on the real estate market (advertising on our website www.centarnekretninazadar.hr and on several real estate portals), check the documents necessary for the valid conclusion of a specific legal transaction, to give an opinion on the market price of the property, provide views of the property, provide in negotiations on the conclusion of the work, prepare a draft of the sales contract, submit the necessary documents to the land registry office for the property registration and to the competent tax authority for taxation on real estate. To be able to offer your property, you need to sign a contract on mediation.
If you sign an exclusive contract, the agent will invest more in advertising your property, because he knows that his investment is safe, given that in this case the commission belongs to his agency. We will be able to put a banner on your property and work with more than one agent which increases the ability to sell, and you will be notified of any action related to your property.
Intermediary fee or commission payable only in the case when the sales contract is concluded by our mediation, is 3% of the agreed purchase price, or a minimum of 800,00 €, payable in kunas. On the amount of compensation is calculated VAT of 25%.
Land registries (Land Registry) are public registers in which are entered the property and property rights on these properties (property right, right to build, lien, right of way, easement right) and other legal relations and facts in connection with real estate transactions. Land registers are kept by the land registry departments in municipal courts.
Land registry certificate is a legal document proving ownership of the property. It consists of three parts:
- Possession data (A-part) contains data on all cadastral parcels that make up a land registry body and all cadastral changes that affect them,
- Proprietorship (B-part) contains information about the owner of the property, changes in the ownership and personal limitations that restrict the owner to use the property,
- Encumbrance sheet (C-part) contains information about the real and other rights which the property is encumbered (mortgage, personal and easement, right to build, mandatory law...).
The buyer must pay the seller the full amount of the agreed purchase price, and the seller is obliged to deliver property to the buyer and allow him the transfer of property rights.
Tabular statement is a document published by the seller, in which he states that he has received the full amount of the agreed purchase price from the buyer, which allows to the buyer the transfer of property rights and ownership. that is the subject of the sales contract.
In Republic of Croatia, real estate transfer tax is 3% of the agreed purchase price, and by law, this tax is an obligation of the buyer.
Within thirty (30) days of the conclusion of the contract on the sale of real estate, the buyer is obliged to submit a tax application to the competent tax authorities. Within fifteen (15) days of receipt of the decision of the competent tax administration purchaser is required to pay the tax calculated.
The energy performance certificate is a document that provides information on the required amount of thermal energy per year consumed by an apartment or a building or for heating and cooling, ventilation, water heating, lighting, etc., and gives a proposal of measures for cost-effective improvement of the energy performance of buildings in order to reduce the amount of the necessary energy. By saving energy and using renewable energy we save personal resources, and a certain grade of energy performance cerfiticate may affect a real estate’s market value. The grades are designated by letters A to G, with G the worst energy class A and A + are the best. The energy certificate is valid for ten (10) years time and by the law, must be available to the buyer before signing the sales contract.
