WHAT IS REAL ESTATE?

Real estate is a particle of the earth's surface, together with everything that is permanently connected to the land on the surface or under it. This means that by buying an apartment, you also buy the ideal part of the building on which the building is built, that is, if you buy a cadastral plot, you become the owner of everything built on it.

WHY HIRE A REAL ESTATE AGENCY TO SELL THE PROPERTY?

Our agency will do its best to find a buyer for your property as soon as possible. We will perform all the necessary actions for the purpose of presenting the property on the market (advertising on our website www.centnarekretninazadar.hr and on various portals), check the documents necessary for the valid conclusion of a certain legal transaction, give our opinion on the market price of the property, provide viewing of the property and mediate in negotiations regarding the conclusion of the deal. In order to be able to offer your property, we need to sign a brokerage contract.

HOW MUCH IS THE BROKERAGE FEE?

The brokerage fee is paid in the case when the purchase contract is concluded through the mediation of a real estate agency, and is calculated in the amount of 3% of the agreed purchase price, unless otherwise agreed in the brokerage contract. 25% VAT is calculated on the amount of the agreed fee.

WHAT ARE LAND BOOKS?

Land registers/land books are public registers in which real estates and real rights on these real estates are entered (right of ownership, right of construction, right of lien, right of easement, right of real encumbrance) and other legal relations and facts related to the legal transaction of real estate. Land books are kept by municipal courts, and in them by land register departments.

WHAT IS A LAND-BOOK EXTRACT?

The land registry extract is a legal document that proves the ownership of real estate. It consists of three parts:

  • Section A - contains data on all cadastral parcels that make up one land registry body and all cadastral changes that apply to them
  • Section B - contains information about the owner of the property, changes in ownership and personal restrictions that limit the owner's disposal of the property
  • Section C - contains information on the real and other rights with which the real estate is encumbered (mortgage, personal and real servitudes, building rights, mandatory rights)

WHAT DOCUMENTATION NEEDS TO BE PREPARED FOR THE SALE OF REAL ESTATE?

Before advertising a property for sale, it is necessary to prepare the following documentation:

  • Extract from the land register with registered ownership in the name of the seller,
  • Cadastral copy.


Additional documentation for houses and apartments:

  • Floor plans and other technical or project documentation,
  • Builging and usage permit,
  • Energy certificate.


Additional documentation for land:

  • Location information or similar.

WHAT IS A TABULAR STATEMENT?

With the tabular statement, the seller declares that he has received the entire amount of the agreed purchase price from the buyer, which allows him to transfer ownership rights to the real estate that is the subject of the purchase agreement.

HOW MUCH IS PROPERTY SALES TAX?

In the Republic of Croatia, real estate sales tax is 3%, and according to the law, the person who acquires the real estate, the buyer, is obligated to pay the tax. After the verification of the sales contract, the notary public submits a real estate transaction tax report to the Tax Administration.

WHAT IS AN ENERGY CERTIFICATE?

An energy certificate is a document that provides information on the required amount of thermal energy in one year consumed by an apartment or building for space heating and cooling, ventilation, water heating, lighting, etc. and provides a proposal for measures to cost-effectively improve energy characteristics in order to reduce the amount of energy. By saving energy and using renewable energy sources, we save personal funds, and the energy class of the property can affect its market value. The classes are marked with the letters A to G. The energy certificate is valid for ten years, and in accordance with Croatian law, the owner of the property is obliged get the certificate before selling, renting or leasing the property.
